The Department of State Security (DSS) failed to produce businessman and Managing Director of Capital Oil and Gas, Ifeanyi Ubah before Justice Muhammed Idris of a federal high court in Lagos.
The court had given an order on Tuesday asking the EFCC to produce Uba and show why he should not be released unconditionally.
This was after Ubah’s counsel filed an ex-parte motion to compel his release from the DSS custody where he had been since Saturday, may the 6th.
But the DSS rather went to a federal high court in Abuja to get an injunction to continue to keep him in custody.
The judge who preferred not to comment on the development adjoined till May the 18th for hearing of the substantive suit.
Ubah was arrested over alleged economic sabotage and diversion of petroleum product.
