The Abuja division of Court of Appeal has ordered the Code of Conduct Tribunal to stay action on proceedings in the trial of the CJN, Walter Onnoghen.
The order follows an appeal filed by the Chief Justice of Nigeria, Walter Onnoghen, on January 14th asking for a restraining order on charges brought against him at the CCT until his challenge of its jurisdiction is determined.
Counsel to the defendant, Wole Olanipekun had filed an application challenging the jurisdiction of the CCT, to handle the charges.
Counsel to the FG, Aliyu Umar, also filed a motion asking the tribunal to order the CJN, to step aside pending the determination of the charges and that the next senior judge of the Apex Court ( Muhammad Tanko) to be sworn in as acting CJN.
In response, Counsel to the FG, Oyekole Oso said that it is the decision of the tribunal whether or not to stay action on proceeding and it does not fall within the powers of the defendant (CJN).
He stressed that the tribunal had adjourned proceedings for the hearing of application challenging its jurisdiction.
But the CCT at its sitting on Tuesday held that it would continue with his trial inspite of an order by a federal high court.
