Justice Okon Abang of the federal high court Abuja, says he will withdraw from a fundamental right suit brought before him by Senator Buruji Kashamu,
The lawmaker is seeking to stop the federal government form extraditing him to the United States of America over drug related offences.
Counsel to the NDLEA, Joseph Sunday, had informed the judge that he had, delivered two judgements in 2015 on the same extradition issue.
The lawyer said further that the two judgments of the high court have been set aside by the court of Appeal in Lagos division and were now at the supreme court.
Justice Abang said that he will opt out of the fresh suit filed late last year if it is related to extradition matter.
But Counsel to Kashamu, Ifeoma Esson insisted that the fresh suit is predicated on the unlawful invasion and siege laid on his client’s house for 6 days by operatives of the NDLEA.
