The Federal High Court Abuja has dismissed the suit seeking to stop President Muhammadu Buhari
from inaugurating the 43 ministerial nominees over the exclusion of an FCT indigene from his cabinet list.
Delivering judgment, Justice Taiwo Taiwo of the federal high court, Abuja held, the applicant is guilty of delay, since the names of the ministers have been confirmed by the National Assembly.
The court has no place to grant an injunction when the applicant has not establish a legal right.
An exercise of the courts discretion is within the competence and purview of the court
Stressing that it was necessary to grant accelerated hearing in the matter other than interim injunctions restraining the president from inaugurating the Ministers.
The court further held that the matter shall be placed on the court list after service is done personally on the respondents ( President and AGF).
The applicant, Mr Musa Baba-panya, who was also the counsel in the case, had last week Thursday approached the court with an ex-parte motion, asking it to stop President Buhari from going ahead with the inauguration.
Baba-panya, who is also an indigene of Karu in the FCT, said the President’s action was contrary to an Appeal Court judgment delivered on March 15, 2018.
