The Court of Appeal has affirmed the election of Senator Ike Ekweremadu of the Peoples Democratic Party in the February 23rd senatorial election for Enugu West District.
In the lead judgment delivered by Justice Salawu, the court dismissed the appeal filed by Juliet Ibekaku-Nwagwu of the All Progressives Congress for lacking in merit.
Justice Salawu said the appellants failed to prove allegations of non-compliance to the Electoral Act and as such were not entitled to the reliefs sought.
The court says that the winner of the election cannot have his election nullified on allegations that the result sheet of the election was not dated.
It also awarded fifty thousand naira costs against the appellants in favour of each of the respondents, which includes PDP, INEC and Ike Ekweremadu.
