Justice Othman Musa of the FCT high court in Bwari has dismissed the suit filed challenging the eligibility of the deputy president of the Senate Ovie Omo-agege over an alleged conviction in the United State of America.
The court held that the case against Senator Omo-Agege in the US was merely a non-criminal trial by a Judicial Commission of Inquiry which does not amount to a conviction.
The court awarded the cost of N1m against the claimant for filing a frivolous suit aimed at denting the image of the Deputy President of the Senate.
Justice Musa stated that the case against the Senetor in the state of California was a disciplinary matter which he challenged in the United states Supreme court and won.
He added that the Senator was not under any obligation to furnish INEC any information in respect to the proceedings in the US.
In his final submission the judge held that Senator Ovie Omo-agege was not under any indictment or conviction and as such he is not a convict.
