The Ibadan Division of the Court of Appeal has set aside the judgment of the Oyo State High Court which declared the attack on the house of Yoruba nation agitator Chief Sunday Adeyemo aka Sunday Igboho illegal.
The court also nullified the N20 billion exemplary and aggravated damages awarded against the Department of State Security (DSS) for the attack, describing it as outrageous.
Justice Muslim Hassan, in his judgment, held that the Oyo State High Court ignored the merit of the case while assuming jurisdiction, adding that the judge should not have awarded damages based on his personal parameters.
It will be recalled that an Oyo State High Court had assumed jurisdiction in the case instituted by the Yoruba Nation agitator in 2021.
The case which was brought before the Court by his lawyer, Yomi Aliu, was for the enforcement of his fundamental human rights.
He also asked that the raid on his residence by a joint team of the Operatives of the Department of State Services and Soldiers was illegal.
He also asked the Court to award damages for the raid.
The Court in its judgment delivered by Justice Ladiran Akintola held that the raid on the residence of Chief Sunday Adeyemo popularly known as Igboho was illegal and an infringement on his fundamental human rights.
The Court also awarded exemplary and aggrabvated damages against the Federal Government, the Department of State Services and the Attorney General of the Federation totalling N20 Billion.
