The Court of Appeal Abuja Division has adjourned till 6th September for hearing on the appeal filed by the Academic Union of Universities against the ruling of the National Industrial court with orders the striking lecturers to return to the classroom.
A three member panel of the appellate court led by Justice Hamman Barka made the adjournment after counsel to ASUU withdraw one out of the two processes it filed.
Counsel to ASUU, Femi Falana had sought to proceed with the remaining application date 28th of September.
In response counsel to the Federal government James Igwu noted that the only application they have been served it the one ASUU had withdrawn.
Mr Falana however provided the court prove of service, as service was made to the Ministry of Justice and not to the counsel of the Federal government.
Although both counsel had agreed that service of processes be made to the chambers of the lead counsel representing the federal government, Mr Falana noted that he was not certain if the federal government was going to retain by Mr Igwe.
The processes were subsequently served on the federal government in court and parties are to return tomorrow for hearing.
A member of the panel Justice Biobele Georgewill however advised both parties to resolve there issues amicably, by doing what is important in the interest of the nation and students, with the hope that tomorrow they made have reached a resolution.
The issue of the resolution of the protracted dispute between the Federal Government and University Lecturers has been on the front burner for sometime with many stakeholders worried at the seeming lack of interest in resolving it on the part of both the Federal Government and ASUU.
The decision by the Court to move hearing into the appeal forward is also another point that will ensure that the dispute is not resolved as soon as possible.
