The scheduled arraignment of the Medical Director of Optimal Healthcare Company, Dr. Femi Olaleye, for allegedly defiling a 15-year old girl was stalled on Monday.
This was due to the absence of the defendant.
The case is before Justice Rahmon Oshodi of the Sexual Offences and Domestic Violence Court, at the Roseline Omotosho Court House, Ikeja, Lagos.
When the case was called up at around 9 am, Olugbenga Alagbe who announced his appearance for the state government, informed the court that they are ready for trial, but added that the defendant is absence.
The prosecutor went on to say that the office of the Directorate of Public Prosecutions at the Ministry of Justice had sent a letter to the defendant and the Investigating Police Officer to notify all parties of the day’s proceedings.
He subsequently urged the court to issue a bench warrant of arrest against Dr. Olaleye.
The defence counsel, led by a Senior Advocate of Nigeria, Babatunde Ogala, apologised for the absence of his client, explaining that he was out of town as at the time the letter was sent to his office on November 18.
He also said though the defendant was not served the court processes, they are ready to receive the documents on his behalf.
The prosecution then served the defence counsel with the court documents.
Mr Ogala also urged the court to grant them a further date for arraignment, and assured that Dr Olaleye will be available at the next date.
