These are trying times for the police community and the Inspector General of Police.
A high court sitting in Abuja has reportedly sentenced the Inspector General police Usman Baba to three months in prison for defying court orders.
Justice Mobolaji Olajuwon, the presiding judge issued the ruling on Tuesday as a result of the suit filed by a former police officer Mr Patrick Okoli who claims he was unlawfully and compulsoryly retired from the police service.
The order in question was issued on October 21st 2011.

But the spokesperson of the police, Olumuyiwa Adejobi denies that his boss, the IG was not in contempt of the Court. The IG was appointed on April 7 2021.
“It is possible to be accountable, guilty of contempt, for an order issued two years ago while you were not the IG at the time if you were aware of the development, formally informed of the court’s ruling, and you failed to act,” veteran journalist, Babajide Kolade-Otitoju said
Speaking further, Mr Otitoju said “Usman Baba joined the police force not long after and was unaware of the occurrence, nor was he aware of the court order, so contempt is not applicable because he was unaware.
“If he was duly served and he failed to take action that would have been a different matter altogether.”
BKO stated that the decision is up to the police, regardless of who was the IG at the time. If the police were asked to reinstate the officer and the Police Service Commission agreed with the Court’s decision that the officer should be reinstated, whoever is the IG must obey the Court’s order.
The IG stated that the police legal department will look into the matter because he was not served with the court order.
The court’s order appears to be absurd. Simply put, the IG should be imprisoned for three months because he failed to carry out an order issued in 2011.
If the IG was properly notified of the court’s order, I believe he would have taken some action.
Furthermore, Publisher FrankTalkNow, Olabisi Deji-Folutile, stated that the complainant must have returned to court to inform the judge that the issue is still pending, therefore the court’s judgment.
“Whoever was in charge at the time the order was issued must have been served, but they most likely refused to carry out that order because it is an institution.
“The issue now is not just about the person in that position, but about the position itself, which is why the judge committed the IG to prison with the provision that if the order is not carried out within three months, he will be recommitted for contempt of court, implying that the court is interested in that order being carried out”.
Mr. Otitoju opinned that in a democracy, no matter how strong you are, you are subject to the rules of the land. If people can wilfully ignore judges, it indicates that we are slowly drifting into an ovatian condition of nature.
Our country must be one in which the primacy of the laws of the land is recognized. People cannot pick which judicial orders to obey, no matter how strong they believe they are.
