The Federal High Court in Benin has restrained itself from further hearing in a case seeking to determine the mode of primary election to choose a governorship candidate for the APC in Edo state.
At its resume sitting , the court held that its decision would enable parties await the outcome of the same suit now pending at the appeal court .
The matter before the court was brought by 2 Chieftains of the Edo state Chapter of the APC, Ken Mozia and , Douglas Ugbankwa.
They are seeking to stop the National working committee of the party from adopting the direct primary method in choosing its flagbearer for the Governorship election in September .
But on resumption on Thursday, after an earlier adjournment, Counsel to the 2nd defendant, Roland Otaru argued that the Court lacked the jurisdiction to have given a stay of execution order on both parties on the 8th of June, hence he approached the court of Appeal asking it to vacate the order of the Federal high court.
He further stressed that the issue of jurisdiction can not be ignored and going ahead with the case will amount to judicial recklessness.
He prayed the court to hands off on the case pending its determination at the court of Appeal.
The Presiding judge, Justice Muhammed Umar accepted and restrained himself from continuing with the case, adjourning till Wednesday, the 17th of June to enable the Appellate Court take its decision.
