The Federal Competition and Consumer Protection Commission (FCCPC) has fined WhatsApp LLC and Meta Platforms, Inc. $220 million for exploiting Nigerian consumers. This follows a thorough investigation by the FCCPC.
According to a statement from the commission, In May 2021, the FCCPC issued a notice to WhatsApp and Meta, accusing them of violating consumer protection and data privacy laws.
Over 38 months, the FCCPC and the Nigeria Data Protection Commission (NDPC) conducted a joint investigation, examining Meta’s privacy policies and practices.
The statement noted that the joint investigation concluded that Meta engaged in multiple violations, including:
1. Denying Nigerians the right to control their data.
2. Unauthorized sharing of personal data, including cross-border transfers.
3. Discriminating against Nigerian consumers compared to other countries.
4. Abusing its market dominance with exploitative privacy policies.
5. Engaging in tying and bundling practices.
Given the substantial evidence and opportunities provided for Meta to respond, the FCCPC has issued a Final Order. This order requires Meta to comply with Nigerian laws, cease exploitative practices, and pay a $220 million fine.
The acting executive vice chairman of the commission Dr. Adamu Abdullahi said the FCCPC remains dedicated to protecting Nigerian consumers and ensuring fair market practices.
