Hearing of all applications in the suit filed by the reinstated speaker of the Lagos House of Assembly, Mudashiru Obasa challenging his removal, failed to hold as scheduled at the Lagos State High Court sitting in Ikeja.
Counsel representing the House of Assembly, Femi Falana (SAN) told Justice Yetunde Pinheiro that he needed to file a response to a court process filed by the speaker’s counsel, Afolabi Fashanu (SAN), and served on the defendants on Monday morning, where it was stated that Mr Obasa was in the country at the time the notice of the purported sitting in which he was removed was sent to all the lawmakers.
Mr Obasa also argues in his latest further affidavit that the said sitting of January 13 in which 33 lawmakers removed him, was unlawful and not properly convened as he wasn’t informed or given a fair hearing to defend the allegations of gross abuse of office levelled against him.
The lead counsel representing Mojisola Meranda who emerged the Speaker after Mr Obasa was removed, Tayo Oyetibo (SAN) also told the court that he needed time to file a response to Mr Obasas claims, as they contained weighty allegations of Fraud against her.
Reluctantly, the Judge granted an adjournment to Monday, March 17 in the interest of Justice in the matter, for hearing of all applications including the substantive action, on that day.
She added the court will determine which application to hear first on the next date.
