Alleged assault: Case against Senator Elisha Abbo opens in Abuja

The Magistrate Court in Zuba, Abuja, has opened its first witness hearing on the criminal assault case against serving Senator Elisha Abbo.

The prosecution’s witness during the cross-examination contradicted herself in some issues addressed by the defence counsel on the written statement she had earlier presented before the court.

The criminal assault case against Senator Elisha Abbo has been ongoing since 8th July 2019, when the senator was first arrested after a video of him physically assaulting a lady at a sex toy shop went viral on social media.

The senator spent one night in jail and was granted bail by the police for the sum of five million naira after the police arraigned the senator on two counts of the criminal assault charge.

This offence is punishable under section 263 and 264 of the penal code law.

Senator Elisha Abbo, was meant to appear in court on 20th August 2019 but couldn’t make it to the trial because he was ill from “acute febrile”
according to his Counsel, Adegbite Adeniyi .

The Counsel also acknowledged receipt of proof of evidence served by the prosecution, adding that they needed more time to go through it and enable themselves to prepare a defence.

The prosecution counsel James Idachaba didn’t raise any objection to the reason for the non-appearance of the senator in court. the court adjourned its hearing to 24th September 2019

The first witness to appear in court on this case, miss Warmate Osimibitra gave evidence as to what happened on the day of the assault during the cross-examination where she contradicted herself on many issued and also changed some of her earlier evidence given before the court.

She also admitted that not all what happened at the sex toy shop was in the video given to the police thereby admitting that the video has been tampered with.

The presiding magistrate adjourned the case to 17th October 2019 for further hearing.
